1. Agreement to Terms

By accessing or using hermez.dev (the “Site”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access or use the Site.

The Site is operated by HERMEZ (“we,” “us,” or “our”), a freelance software engineering and content creation practice.

2. Services

We offer web development services organized into three tiers — Starter, Professional, and Enterprise — as well as specialized services including consultation, bug fixing, cloud architecture, AI integration, codebase modernization, product MVP development, and DevOps/CI-CD setup. All services and pricing are described on our Services page and are subject to change without notice.

A detailed project brief, timeline, and deliverables will be agreed upon before work begins. Any changes to scope after agreement may affect pricing and delivery dates.

3. Payment Terms

• All payments are processed securely through PayPal. We do not collect, store, or have access to your credit card numbers, bank account details, or PayPal login credentials.
• For projects totaling $500 or more, a 50% deposit is required upfront. The remaining balance is due upon project completion, before final files and assets are delivered.
• For projects under $500, full payment is collected at checkout.
• All prices are listed in USD.
• A payment confirmation receipt is sent to the email address you provided at checkout upon successful payment.

4. Refund Policy

Our refund policy is outlined in detail on the Refund Policy page. In summary:

• Full refund if cancelled before work begins.
• 50% refund within 48 hours of project kickoff.
• No refund after the first deliverable is shared.

5. Intellectual Property

Upon full payment, you receive ownership of the custom code and design deliverables created specifically for your project. We retain the right to use general techniques, knowledge, and non-proprietary code in future projects.

Third-party libraries, frameworks, fonts, or assets used in your project remain under their respective licenses.

We reserve the right to showcase completed work in our portfolio and case studies unless a non-disclosure agreement is in place.

6. Client Obligations

• Provide accurate and timely content, assets, and feedback as needed for the project.
• Respond to communications within a reasonable timeframe. Projects may be postponed or cancelled if there is no response for 14 consecutive days.
• Ensure you have the rights to all content you provide for use in the project.

7. Revisions

Each service tier includes a specified number of revision rounds (Starter: 2, Professional: 3, Enterprise: 3). Additional revisions beyond those included can be purchased as add-ons at the rate listed on the Services page.

A “revision” constitutes a round of changes communicated in a single request. Multiple back-and-forth messages about the same deliverable may count as separate revision rounds.

8. Limitation of Liability

To the fullest extent permitted by law, HERMEZ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our services, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim related to our services shall not exceed the amount you paid for the specific service giving rise to the claim.

9. Disclaimer of Warranties

Our services and the Site are provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or free of harmful components.

10. Affiliate Links

Some pages on this Site (such as the Gear page) contain affiliate links to Amazon and Razer products. If you purchase through these links, we may earn a small commission at no extra cost to you. Affiliate relationships are disclosed on the relevant pages. We only recommend products we personally use and believe in.

11. Site Content

All content on hermez.dev — including text, graphics, logos, code snippets, blog posts, and videos — is the property of HERMEZ unless otherwise stated. You may not reproduce, distribute, or create derivative works without prior written permission.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in our Privacy Policy.

13. Termination

Either party may terminate a service agreement with written notice. In the event of termination, you will be billed for work completed up to the termination date. Refunds for incomplete work will follow our Refund Policy.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

14. Governing Law

These Terms of Service shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or the use of our services will be resolved through good faith negotiation. If negotiation fails, either party may pursue resolution through PayPal's Resolution Center or through appropriate legal channels.

15. Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Site after changes constitutes acceptance of the new terms.
